The short version: Orcah Studio runs on your Mac, with your hardware and your footage. Keep backups, and understand that we can't take responsibility for your computer. The full terms are below.

1. Who we are and what this covers

Orcah Studio ("Orcah", "we", "us") is operated by Orcah. These terms are the agreement between you and us for the Orcah Studio desktop app, this website, and any updates we provide (together, the "Software").

By buying, downloading, installing, or using the Software you agree to these terms. If you don't agree, don't use it, and ask for a refund within 30 days (section 4).

The open source project (Edit Mind) is separate and is governed by the license in its own repository, not by these terms.

2. Your license

When you buy Orcah Studio we give you a personal, non-exclusive, non-transferable license to install and use it on Macs that you own or control, for your own personal or professional work.

You may not copy, resell, sublicense, rent, or share the Software or your license; reverse engineer it or work around license checks, except where the law says you can't be prevented from doing so; or use it to build a competing product.

The license is called lifetime because the app keeps working after your purchase. Updates are covered in section 3.

3. Price, payment, and updates

The price is shown at checkout. Payments are handled by our payment provider, Polar, which acts as the seller of record and collects any applicable taxes. Their terms apply to the payment itself.

Your purchase includes every update for one year from the purchase date. After that, the version you have keeps working, and you can optionally renew to receive newer updates.

4. Refunds

If Orcah Studio isn't right for you, email contact@orcah.app within 30 days of purchase and we'll refund you in full. No reason needed. After 30 days, refunds are at our discretion unless the law gives you a right to one.

5. Your computer, your drives, and your data

Orcah Studio runs machine-learning models directly on your Mac. That means it can use a lot of processor, graphics, memory, and disk capacity for long periods, especially when indexing large libraries. The first run also downloads models that need roughly 20 GB of free space.

Orcah Studio links to your video files where they are and does not move or edit your originals. Some formats, such as MXF, are transcoded to MP4 and the new file is saved in the same folder as the original, which uses extra storage on that drive.

You are responsible for your hardware and your data. That includes keeping current backups of your footage, making sure your Mac and any external drives or NAS have adequate power, cooling, ventilation, and free storage, and checking that your setup is suitable for sustained heavy workloads.

We don't provide, extend, or replace any warranty or support for your computer, storage devices, or peripherals, and we aren't responsible for what the manufacturer's warranty does or doesn't cover. If you're unsure whether sustained heavy use fits your manufacturer's warranty or your hardware's limits, check with them before indexing.

6. No warranty

Orcah Studio is currently in public beta. Features may change, and bugs are likely.

We work hard to make it dependable, but search, transcription, face and object recognition, scene descriptions, and agent answers can be wrong or incomplete. Check results before relying on them.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE SOFTWARE WILL BE COMPATIBLE WITH YOUR COMPUTER, STORAGE DEVICES, OPERATING SYSTEM VERSION, OR THIRD-PARTY EDITING SOFTWARE, OR THAT IT WILL NOT AFFECT YOUR HARDWARE'S PERFORMANCE, TEMPERATURE, BATTERY, OR LIFESPAN.

7. Limit of liability

Nothing in these terms excludes or limits liability that can't legally be excluded, such as liability for death or personal injury caused by negligence, for fraud, or your statutory consumer rights. Where the law gives you rights that can't be waived, those rights stay in place.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY DAMAGE TO, LOSS OF, OR MALFUNCTION OF YOUR COMPUTER, EXTERNAL DRIVES, NAS, OR OTHER HARDWARE, OR FOR ANY LOSS OR CORRUPTION OF DATA OR FOOTAGE, LOSS OF PROFITS, LOST WORK, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SOFTWARE IS LIMITED TO THE AMOUNT YOU PAID US FOR YOUR LICENSE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

8. Faces, people, and what you index

Orcah Studio can recognize and group faces, read on-screen text, and transcribe speech. You are responsible for having the right to index the footage you point it at, and for following the laws that apply to recording and identifying people, including consent, biometric, and privacy laws where you or the people in your footage are located.

Your footage and index stay on your Mac by default. If you choose an optional feature that sends data to a cloud service, that data is handled as described in our Privacy page, and you should only use it with footage you're allowed to send.

9. Third-party software and trademarks

Orcah Studio works alongside other products, such as Final Cut Pro, DaVinci Resolve, and Adobe Premiere Pro. These belong to their owners and aren't affiliated with or endorsed by us. Some features, such as MXF transcoding, depend on third-party software having its own terms and being installed by you.

The Software includes open source components that are licensed separately, and those licenses apply to them.

10. Ending the agreement

You can stop using the Software at any time. We can end your license if you seriously or repeatedly break these terms, for example by sharing or reselling your license. If we do, we'll tell you why by email, and if the cause was ours rather than yours, we'll refund the unused part.

Sections that by their nature should continue after the agreement ends, including sections 5 to 8, will continue.

11. Changes to these terms

We may update these terms as the product changes. The date at the top shows the latest version. If a change materially affects you, we'll email you or show a notice in the app before it takes effect. Continued use after that means you accept the new terms. Purchases made before a change keep the terms they were bought under unless the change is clearly in your favor.

12. Governing law

These terms are governed by the laws of Morocco, and disputes will be handled by the courts of Rabat - Morocco, except where mandatory consumer law in your country gives you the right to use your local courts.
